Article 1 - General

Biosphertia Sp zoo complies with the "Law of 8 December 1992 on the protection of privacy in relation to the processing of personal data", as amended by the Law of 11 December 1998, as well as the anti-spam provisions of Book XII of the Code of Economic Law on the "law of the electronic economy".

Biosphertia Sp zoo also complies with the European Regulation 2016/679 of 27 April 2016 on the protection of personal data.

The party responsible for the processing of your personal data is Biosphertia Sp zoo. A statement has been made to the Commission for the Protection of Privacy regarding the processing of your personal data.


Article 2 - Personal data


2.1 Personal data that you provide to us (and third parties)


Category 1


Without registration: non-personally identifiable information. Your IP address (anonymous), the type and version of your navigation system and the last visited internet page, your visited web pages on our website, interactions with our website, geo-location and traffic source, etc. are tracked by Google and made available to Biosphertia Sp zoo via Google Analytics. The services they offer enable Biosphertia Sp zoo to monitor and analyze internet traffic.
This can be used to map user behavior. We would like to refer to the privacy policy of Google Analytics because this list is not exhaustive. Our websites may use the tool 'Hotjar Analysis and Feedback'. By using Hotjar, we gain insight into how you use our websites, your online behavior on our websites and your feedback. By combining tools for both analysis and feedback, Hotjar gives us a general idea of what we can do to improve your user experience and make our websites more efficient. Hotjar is not used to collect personal information, nor do we provide such information to Hotjar. We only use Hotjar to record your visitor behavior on our websites, and this completely anonymously.
This information may include, for example, the number of mouse clicks, mouse movements and scrolling activity, as well as non-personally identifiable information that you enter on our website, for example. Information about the browser (type, version, screen size, etc.), basic information about the user (IP address, language, time zone) and data about mouse movements, mouse clicks and scrolling activity are transmitted to Hotjar. No personal data will be sent. Hotjar uses a range of services that are performed by external partners, such as Google Analytics. (Google Analytics Privacy Policy) Keystrokes in password fields and fields marked "confidential" are never stored or sent over the network.

If the analyses on our websites show that certain parts need improvement, we can use Google Optimize to test which new display you prefer. Google Optimize is part of Google Analytics and does not collect any personal data. Google's privacy policy also applies here.

2.2 The website of Biosphertia Sp zoo may collect your personal data in various ways.


a) by using cookies (see Article 8);
b) during your registration, leaving details on and using our websites (Examples: contests that take place on our websites, the possibility to be informed when a book is available again (by leaving your e-mail address), creating an account, placing an order,... The examples cited are not exhaustive);
c) by issuing a business card or other registration with an opt-in at a trade fair or any event or through a personal contact.


2.3 Our websites use cookies that collect some data.


For the provisions regarding the use of cookies, see article 8.
Certain data may also be collected without being stored in cookies. They can only be read by Austrian winery Biosphertia Sp zoo and only during and after your visit to the websites. These are
    • the TCP/IP address;
    • the type and version of your navigation device;
    • the last visited internet page.
 

Article 3 - Purposes of the processing


3.1 General purposes


Biosphertia Sp zoo will only use the personal data collected from you for the following purposes:

To provide and improve our websites and to include personal data in anonymous statistics, from which the identity of specific persons or companies cannot be determined, with the legal basis being the legitimate interests of Biosphertia Sp zoo to continuously improve its websites and services;

The management of your account on our websites for the purpose of use by Biosphertia Sp zoo and its websites, the legal basis of which is the performance of an agreement requested by you, and, if indicated by you, also the sending of direct marketing, the legal basis of which is your explicit, prior consent;

Sending you direct marketing, newsletters, actions and promotions, with your explicit, prior consent as the legal basis;

We use cookies to identify you as a logged-in user to optimize your shopping experience: this allows us to keep track of your products in your shopping cart and remember your discount code. They also help with the smooth handling of your order. Our cookies also make it possible to share web pages via social networks, keep track of whether you have activated Javascript in your browser and make it possible to show relevant advertisements based on your visit to our websites. In article 8 you will find a complete overview of our cookies. We can only use it with your explicit, prior consent as the legal basis;

The delivery and invoicing of products ordered by you, with the legal basis of providing a service requested by you.
You are not obliged to disclose your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing.


3.2 Direct marketing


Your personal data will be kept strictly confidential and will not be communicated to third parties or used for direct marketing purposes, unless Biosphertia Sp zoo has obtained your explicit prior consent ("opt-in").
You may receive newsletters from Biosphertia Sp zoo if you have signed up for our newsletters via our websites in the past, if you have given permission to receive our e-mail communication via e-mail, when registering for an event or through competitions that we organise on our websites and/or fairs, or by placing an order on one of our websites.
If you are already included in our database for receiving marketing material in paper and/or electronic form, Biosphertia Sp zoo may use your data to send marketing and other material relating to Biosphertia Sp zoo, its products and/or services. Biosphertia Sp zoo may use the data you provide to update documents stored by Biosphertia Sp zoo.
This consent can be withdrawn at any time, without justification and free of charge, for example by clicking on the unsubscribe link provided for this purpose, at the bottom of each (promotional) e-mail message or by sending an e-mail to hostmaster@oostenrijkswijnhuis.be


3.3 Transfer to third parties


In the event of a full or partial reorganization or transfer of activities of Biosphertia Sp zoo, whereby it reorganizes, transfers, ceases its business activities or if it goes bankrupt, this may mean that your data will be transferred to new entities or third parties through which the business activities of Biosphertia Sp zoo are carried out in whole or in part.
Biosphertia Sp zoo will make reasonable efforts to inform you in advance of the fact that Biosphertia Sp zoo will disclose your data to the said third party, but you also acknowledge that this is not technically or commercially feasible under all circumstances.
Biosphertia Sp zoo   will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described above or unless with your prior consent.


3.4 Legal requirements


In rare cases, Biosphertia Sp may be required to disclose your personal data pursuant to a court order or to comply with other mandatory laws or regulations. Biosphertia Sp zoo will make a reasonable attempt to inform you about this in advance, unless this is subject to legal restrictions.


Article 4 - Sustainability of processing


The personal data is stored and processed by us for a period that is necessary in function of the purposes of the processing and in function of the contractual relationship between Biosphertia Sp zoo and you.
Your order data will be kept for a minimum of 10 years for accounting reasons. The owners of accounts that have not been used for more than 10 years and can therefore be considered inactive will be contacted to ask if their account should still exist. If we do not receive an answer to this question within 3 months, your account will be automatically deleted. The owners of accounts that did not place orders will be contacted after 5 years of inactivity to ask if their account should still exist. If we do not receive an answer to this question within 3 months, your account will be automatically deleted.
Your subscription to our newsletters will remain valid until you unsubscribe from them or for a maximum of 5 years if we notice that you no longer interact with e-mail communication associated with our websites or direct marketing.


Article 5 - Your rights


5.1 Right of access and inspection


You have the right to access your personal data free of charge at any time, as well as the use we make of your personal data.
You can find a large part of your data when you log in to our website and take a look at 'My account'. Don't have an account on one of our websites but do you receive our newsletters? Via 'Change Preference' at the bottom of our newsletters you can find your permissions and interests. Do you want to gain insight into all the information we process about you? For security reasons, we have shielded it a little more and can also be found under 'My account' after creating an account.


5.2 Right of rectification, deletion and restriction


You are free to decide whether or not to communicate your personal data to Biosphertia Sp zoo. In addition, you always have the right to ask us to correct, supplement or delete your personal data. You acknowledge that in the event of refusal of communication or request for deletion of personal data, certain services and products will not be available and that you are solely responsible for the accuracy of the data you provide to Biosphertia Sp zoo. You may also ask us to restrict the processing of your personal data.

5.3 Right to object


You also have the right to object to the processing of your personal data for serious and legitimate reasons.
In addition, you always have the right to object to the use of personal data for direct marketing purposes; In such a case, you do not have to give reasons.
However, you cannot object to the processing of your personal data if this is necessary for the execution of the contractual obligations.


5.4 Right to free data transfer


You have the right to obtain your personal data processed by us in a structured, commonly used and machine-readable format and/or to transfer it to other controllers.


5.5 Right to withdraw consent


Insofar as the processing is based on your prior consent, you have the right to withdraw that consent.


5.6 Exercising your rights


Our websites and the e-mail program we use store interactions for the purpose of personalizing and making the content of our websites and newsletters relevant. You have the right to oppose automatic decisions and profiling. To oppose the personalizations and relevant content you receive through our email program, you can unsubscribe at any time. To oppose other forms of profiling or automatic decisions, you can exercise your rights as described in section 5.7.


5.7 Automatic decisions and profiling


You can exercise your rights by contacting us for this purpose, either by e-mail to info@rosasway.com, by post to Biosphertia, Patersstraat 100, 2300 Turnhout (Belgium) or by using the 'Contact' section on the websites, provided that you enclose a copy of your identity card. We will make every effort to respond to your request as soon as possible and will respond in writing or electronically and provide one copy of the data concerned free of charge within 30 days of your request.
5.8 Right to lodge a complaint
You have the right to lodge a complaint with the Belgian Privacy Commission: Commission for the Protection of Privacy, Drukpersstraat 35, 1000 Brussels, Tel +32 (0)2 274 48 00, Fax +32 (0)2 274 48 35, e-mail: commission@privacycommission.be.
This is without prejudice to an appeal before a civil court.
If you suffer damage as a result of the processing of your personal data, you can file a claim for damages.


Article 6 - Security and confidentiality


6.1


Biosphertia Sp zoo has developed all reasonable security measures adapted from a technical and organisational point of view, in order to prevent the destruction, loss, falsification, alteration, unauthorised access or accidental disclosure to third parties of personal data collected and any other unauthorised processing of this data.

Under no circumstances can Biosphertia Sp zoo be held liable for any direct or indirect damage resulting from an incorrect or unlawful use of the personal data by a third party.
We would also like to inform you that our websites may contain links, hyperlinks or references to other sites that Biosphertia Sp zoo does not control and to which this Privacy & Cookie Policy does not apply. These sites are not always managed by Biosphertia Sp zoo and we are not responsible for the content of the websites referred to or for the offers, products or services mentioned on them. We therefore recommend that you carefully read each privacy policy of each site you visit, as it may differ from this Privacy & Cookie Policy.

8.6 Deleting cookies


Microsoft Edge: Click on the Menu icon (icon with 3 dots) at the top right. Then click on 'Settings' and then on 'Choose what to delete' under browser data. There you can check the desired options and click on clear. (In any case, check Cookies and saved website data.)
Chrome: Click on the icon with 3 dots in the top right. Click Settings > Advanced > Privacy & Security > Clear Browsing Data. In any case, make sure that 'Delete cookies and other site and plug-in data' is checked. You can also indicate how old the Cookies should be under 'Period'. Choose 'Always' here.
Firefox: Click on the icon with 3 lines at the top right. Go to "Preferences" > "Privacy & Security." Click "Clear your recent history." Under 'Details' you can indicate exactly what you want to delete. In any case, check 'Cookies'. You can also indicate how old the Cookies should be under 'Time period to be deleted'. Choose 'All' here.
Safari: Click Safari > Preferences in the upper-left corner of the menu bar. At the top of the window, choose the 'Privacy' tab. Then click on 'Manage website data' and choose 'Remove all'.


Article 9 - Applicable law and jurisdiction clause


This Privacy & Cookie Policy is governed, interpreted and implemented in accordance with Belgian law, which applies exclusively in the event of any dispute. The courts of Antwerp have exclusive jurisdiction to rule on any dispute that may arise from the interpretation or implementation of this Privacy & Cookie Policy.


Article 10 - Acceptance


By visiting our websites, when creating an account, subscribing to our newsletter and at the latest at the time of your order, you accept all the provisions of this Privacy & Cookie Policy and you agree that Biosphertia Sp zoo collects and processes your personal data in accordance with this Privacy & Cookie Policy. This policy can be changed at any time, so it is recommended to check regularly whether any changes have occurred.
